WHAT IS A PROBATION VIOLATION IN MIAMI-DADE COUNTY?
Probation violation is an offense that occurs when you break the terms or conditions of your probation. The consequences associated with probation violation usually depend on a variety of factors, such as the nature and seriousness of the violation, whether you have any prior violations, and whether there are other circumstances that may lessen (or worsen) the severity of the situation. A probation violation may result in significant penalties, such as heavy fines, extended probation, jail time, or more.

There are a number of ways that probation may be violated. Following are some examples of technical probation violations:
  • Failure to report to a probation officer
  •  Failure to pay a court-ordered fine
  •  Failure to pay restitution as ordered by the court
  •  Failure to perform community service
  •  Violation of a restraining order or order of protection
  •  Drug or alcohol abuse
A substantive violation occurs when arrested for a new crime. If on probation for a violent felony, you can be labeled a violent felony offender of special concern (VFOSC) which could result in a minimum mandatory prison sentences.
We defend all crimes such as:
  • Felony violation of probation
  •  Misdemeanor violation of probation
  •  Bench Warrants
  •  Alias Capias (AC)
  •  Arrest Warrant Surrenders
PROBATION VS. COMMUNITY CONTROL VIOLATIONS
Community Control is a form of house arrest, and this penalty may be imposed for up to 2 years in Florida. Often house arrest will be followed by probation, which will require mandatory reporting to your probation officer as well as other requirements and restrictions. Violating Community Control is a serious offense, just as a probation violation. If convicted, the offender may face imprisonment as his or her house arrest or probationary period is revoked.
