Failure to Appear

Failure to appear is a legal term that describes when a defendant fails to make a scheduled court appearance at a given date and time. If a person fails to appear in court once, the judge may simply look the other way and reschedule the legal proceedings. However, if a person fails to appear in court more than once, a judge may decide to issue a bench warrant, which will allow law enforcement to arrest the person in question. Bench warrants are typically issued in criminal cases. In civil cases, the judge may default judgment to the plaintiff in the case, simply because the defendant was not present for the proceedings.
